(“Company,” “we,” or “our”) User: Any person or entity registering, accessing, or using the xQuantum platform or its related software and services (“User,” “you,” or “your”). Scope: This Disclaimer applies to all xQuantum products, software, services, communications, and content, including but not limited to the xQuantum web platform, application programming interfaces (APIs), mobile applications, data feeds, and promotional materials (collectively, the “Platform”).


1. General Information

All information, content, and materials provided through the xQuantum Platform are provided for general informational and technological purposes only.

xQuantum is a broker technology provider, not a broker-dealer, financial advisor, or investment firm. The Platform facilitates access to trading tools and integrations with third-party brokers and liquidity providers but does not execute trades, manage investments, or provide advice or recommendations of any kind.

xQuantum makes no representations, warranties, or guarantees — express or implied — regarding the accuracy, reliability, completeness, or timeliness of any data, analysis, or information provided.


2. No Financial or Investment Advice

Nothing on the Platform constitutes or should be construed as:

  • An offer, solicitation, or recommendation to buy, sell, or hold any financial instrument;

  • Personalized financial, investment, tax, accounting, or legal advice;

  • A projection or guarantee of financial performance.

Users are fully responsible for their own trading and investment decisions. All market data and tools are provided on an “as-is” and “as-available” basis solely for Users’ discretionary use.

We strongly recommend that all Users consult independent, licensed financial advisors before making investment or trading decisions.


3. No Portfolio Management or Execution Responsibility

xQuantum does not:

  • Execute, clear, or settle any trades;

  • Act as a broker, dealer, market maker, or custodian;

  • Offer or manage trading accounts or client funds;

  • Supervise or verify User trading activities or performance.

Trades initiated through integrated broker connections are subject to the terms and conditions of the respective regulated broker or counterparty. xQuantum bears no liability for execution errors, connectivity issues, or broker-side failures.


4. Risk Disclosure

Trading and investing in financial markets involve substantial risk of loss and may not be suitable for all investors. The use of leverage can magnify both gains and losses — potentially exceeding initial capital deposits.

Users should consider their financial circumstances, experience level, and risk tolerance before participating in any form of trading activity using the Platform.

Past performance, whether actual or simulated, is not indicative of future results. No data, analytics, or simulations provided via xQuantum guarantee profitability or reduced exposure to loss.

Users acknowledge that:

  • Market conditions are unpredictable;

  • There is risk of partial or total capital loss;

  • Technical failures, including internet disruptions or hardware issues, may impair trade execution or data accuracy.

xQuantum assumes no responsibility for losses, damages, or liabilities arising directly or indirectly from platform use or reliance on information obtained through it.


The Platform may display or provide access to third-party content, market data, broker APIs, analytical tools, or websites. Such materials are provided solely for convenience and do not constitute endorsement or verification.

xQuantum does not control or guarantee the accuracy, legality, or availability of third-party information and disclaims liability for any damages arising from reliance on or use of such external services.


6. Limitation of Liability

To the fullest extent permitted by law, xQuantum, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to:

  • Use or inability to use the Platform or related services;

  • Errors, inaccuracies, or omissions in information or data;

  • Any loss of profits, investment capital, or trading opportunity;

  • System failures, interruptions, or unauthorized access.

xQuantum’s total aggregate liability to any User shall not exceed the total fees paid by that User for the use of the Platform during the twelve (12) months preceding the incident that gave rise to the claim.


7. Regulatory Status

xQuantum is a software and technology service provider only. It is not registered or licensed by the U.S. Securities and Exchange Commission (SEC), Commodity Futures Trading Commission (CFTC), National Futures Association (NFA), or any financial regulator in other jurisdictions as a broker-dealer, investment advisor, or futures commission merchant.

All regulated financial services accessible through the xQuantum Platform are provided exclusively by separately licensed third-party institutions.


8. No Warranty

The Platform and all related materials are provided “as is” and “as available”, without any representation or warranty of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.


9. User Acknowledgment

By using xQuantum, the User acknowledges and agrees that:

  • They understand and accept all financial and operational risks related to trading

  • xQuantum bears no liability for any financial loss;

  • Reliance upon any Platform data, analysis, or functionality is entirely at the User’s own risk.
